The website pages, their content and infrastructure, as well as online booking of the services that are provided on the pages and through this website (the "service") are owned, managed and provided by isratourist.com (hereinafter - "isratourist.com"," we", "us" or "our ") and are rendered for your personal and non-commercial use only in compliance with the terms and conditions of use set out below.
1. Services Description
Through this website, we (isratourist.com and its affiliated companies (affiliate distribution partners)) provide an online platform for various services, and the visitors of the website can book these services. When you make a reservation through isratourist.com, you enter into a direct (legally binding) contractual relationship with a particular service provider whose service you book. From the moment you make your reservation, we act merely as an mediator between you and the service provider, transmitting the details of your reservation to a particular service provider and sending you a confirmation email on behalf of the provider.
When supplying our services, on the website we use the information provided to us by the service providers. Service providers have access to their database, and bear full responsibility for updating the prices and other information displayed on our website. Although we do everything possible to provide high level of services, we cannot guarantee the completeness, correctness or accuracy of all the information and are not responsible for any errors (including typographical errors), interruptions (resulted from either temporary and/or partial breakdown, repair, maintenance or upgrade of our website, or anything else), inaccurate, misleading or false information. Each service provider is always responsible for the accuracy, completeness and correctness of the information displayed on our website (including prices). Our website is not and should not be considered as a recommendation or endorsement of the quality, service level or rating of any service provided.
2. Prices and Best Price Guarantee
When displaying search results, you can see your personal price of the chosen services on the basis of your individual parameters. Any price offer automatically takes into account all possible discounts, if provided by service providers. Search results are displayed from the lowest to the highest price.
The currency converter serves for information purposes only and should not be considered as accurate and relevant; actual rates may be different.
Obvious errors (including typographical errors) do not produce any legal effect and cannot be the basis for claims of a material nature. All special promotions and offers on the website are marked accordingly.

4. Free service
We provide our service free of charge, since, in contrast to many other companies, we do not charge for our service or add any additional (booking) fees to the services cost.
5. Credit Card
In case your credit card is used illegally or fraudulently by third parties, most of the banks and companies that issue credit cards cover the cost of all damages caused by the illegal use of the credit card (usually set at EUR 50 or the equivalent in local currency). In order to get the compensation, inform the company that issued your credit card about the fraud (in accordance with its policies and established procedures) and contact us immediately via our feedback form. Please write “credit card fraud” in the subject line of your email.
6. Cancellation
By making a reservation with a service provider, you confirm your agreement with the policies applicable in the event of order cancellation, as well as with all additional terms and conditions that may apply to your booking. Please note that certain tariffs and special offers are not subject to cancellation or change. We recommend that you carefully read the description of a specific service and specific policies before making your reservation. Please note that bookings requiring the deposit or prepayment (full or partial) can be cancelled (without prior notice or warning) in case the appropriate (remaining) amount(s) cannot be written off in full on the relevant payment day according to booking and service provider payment policies. The responsibility for late payment, incorrect debit or credit card details, or insufficient funds on the card is assigned exclusively to you, and you have no right to claim the return of any (non-refundable) prepaid amount unless the service provider agrees or permits otherwise in accordance with his pre-payment and cancellation policies.
If you want to view, modify or cancel your order, please turn to the confirmation email and follow the instructions therein. Please note that you may be charged for the cancellation in accordance with the service provider pre-payment and cancellation policies. We recommend that you carefully read the cancellation policies.
7. Rating and Tourists’ Reviews
Please note that the Rating is created by a fully automated rating system (algorithm) by default, and is based on a set of criteria.
Your review may be used by isratourist.com at its sole discretion (for example, for marketing or promotional purposes, as well as to improve the services provided by the company) on its website and other similar social media platforms, newsletters, special promotions, applications or when using any other products owned or controlled by isratourist.com. The company reserves the right to modify, refuse or remove reviews at its sole discretion.
8. Liability Limitation
According to the limitations set forth in these terms and conditions within the legislation framework, we are liable only for direct damages actually suffered or damages caused as a result of the actual failure to fulfill our obligations in respect to our services up to an aggregate amount of the aggregate cost of your order, as specified in the confirmation email (whether for one event or series of connected events).
Despite this, neither our company nor our offices, directors, representatives, employees, subsidiaries, affiliated companies, distributors, affiliate distribution partners, licensees, agents and other companies or individuals involved in the creation, sponsorship, promotion and any other activities in support of this website and its content, shall be liable according to law for (1) any punitive, special, indirect or consequential loss or damage, any loss of products, profit, revenue, contract, loss of or damage to goodwill or reputation, and failing to resolve a claim for damages, (2) any inaccuracy relating to the price or the service rating provided on our website, (3) any (direct, indirect, consequential or punitive) damages, losses or costs incurred or paid by you and arising out of or resulting from the use, inability to use or delay of our website.
When uploading the photos/images to our system (e.g. addition to a review), you confirm, guarantee and agree that you are the copyright owner of these photos/images and you agree that the company isratourist.com use the photos/images uploaded to your (mobile) website or to a mobile phone application, in promotional materials and publications (placed online or offline) or in any other manner at the discretion of the company isratourist.com. You grant isratourist.com a non-exclusive, worldwide, irrevocable, unconditional and perpetual right and permission to use, reproduce, display, copy, distribute, license, transfer and place the photos/images in any manner at the discretion of the company isratourist.com. When uploading these photos/images, an individual who uploads the photo(s) assumes full legal and moral responsibility for all legal claims by third parties (including but not limited to service providers), in connection with the publication and use of these photos/images by isratourist.com. Isratourist.com does not own the uploaded photos/images and does not endorse them in any way. The responsibility for the authenticity, validity and right to use all photos/images is assumed by the person who uploaded the photo, not by isratourist.com. Isratourist.com assumes no responsibility or liability in respect of the uploaded photos. The person who uploaded the photos ensures that the photos/images do not contain viruses, trojans, or virus infected files and do not contain any pornographic, illegal, obscene, insulting, inappropriate or irrelevant material and do not violate third party (intellectual property right, copyrights, or the right to privacy) rights. Any photo/image that does not meet the above criteria will not be posted and/or can be removed by isratourist.com at any time and without prior notice.
9. Intellectual Property Rights
Unless specified otherwise, all the software required for our services and/or used by our website, and the intellectual property rights (including copyright) belong to isratourist.com.
Any unauthorized action would constitute a considerable violation of our intellectual property rights (including copyrights and database access right).
10. Miscellaneous
These terms and conditions and provision of our services are regulated and exercised in accordance with Israeli law. All disputes arising out of these general terms and conditions and our services shall exclusively be dealt with in the competent courts of Tel-Aviv (Israel).
The original Russian version of these terms and conditions may have been translated into other languages. In this case, the translated version is merely an unofficial and office translation, and you cannot claim any rights on the basis of the translated version of these terms and conditions. In case of disputes about the content or interpretation of these terms and conditions, or inconsistency or discrepancy between the Russian version and any other language version of these terms and conditions, the Russian language version shall be applied and is indisputable. The Russian language version of these terms and conditions is available on our website (when selecting the Russian language). If any provision of these terms and conditions is or becomes invalid, unenforceable, or will cease to be binding, all other provisions of these terms and conditions of use shall be applied.
